Three waiters working the higher priced seats at Yankee Stadium have filed a lawsuit alleging that their tips were unlawfully withheld by former management company Volume Services America (now Centerplate) and current management firm Legends Hospitality Services, reports Crain's New York Business.

The plaintiffs, who worked delivering food and beverages to field level seats in both the old and new Yankee Stadiums, say that a 20 percent service charge added to menu items served at the premium seats is a gratuity owed to the servers, and withholding it violates New York labor laws. Centerplate held the concessions and foodservice contract at Yankee Stadium until the new Yankee Stadium opened in 2009, when Legends took over.
